You may or may not fail since they are pending, but once they say it is certified you'll be golden

Not exactly, it means the certification is "pending." That means that is is not yet legal but they are working on it. And of course it might suck up water, any cold air intake has that risk

I have both a cold air intake and a OEM replacement (I switch out between the 2 depending on the time of year) Yes they are worth the money
